Interpretation & Variation

In the Terms and Conditions the following definitions apply:

“Noue yoga” or “noue yoga” means Noue Yoga (sole trader business).

“Client” or “customer” or “participant” means any person that has purchased a Class or Course, signed a Consent Form, or taken one or more Classes or Courses with Noue Yoga.

“Class” means a Yoga Class (or any other style of class made available on the timetable) provided on behalf of Noue Yoga.

“Course” means a set of yoga classes that combine to create a cohesive course.

“Event” means a yoga based event provided by Noue Yoga or on behalf of Noue Yoga.

“Consent Form” means the Consent Form signed by a Client where appropriate.

“Terms and Conditions” or “Terms & Conditions” as defined here.

“Website” means www.noueyoga.co.uk or affiliated websites.

Noue Yoga reserves the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary or suitable for the business or the clients. Any such changes will be published on our websites and, until revoked, are binding on Clients. The Terms and Conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts. Our Terms and Conditions are part of the Noue Yoga student form and completing and submitting the student form also accepts the Terms & Conditions.

New Customers

New customers need to book onto a class, event or course at least 24 hours prior to its start time using the online booking system on the website. They will also need to fill out the Student Form to inform Noue Yoga of their current health status, any serious medical conditions or injuries and to accept responsibility for any injuries or accidents that might occur during the delivery of the class, event or course. Noue Yoga is not a medical professional or a replacement for medical advice and is not responsible for any damage or injuries that occur during practice. New customers will need to accept and agree to the terms on the New Student form to accept this responsibility before joining a class, event or course.

Please arrive on Zoom or to an in-person class, event or course on time, preferably 5-10 minutes before the start of class so that there is time to let everyone into the online or in-person space and the class, course or event can begin on time. Once the class has started, no late arrivals will be permitted to enter the class.

All participants of online yoga classes and course must have done the following to join the class:

  • Checked the area where they’re practicing and have made sure there are no obstacles or hazards.

  • Completed the student form and confirmed that they are fit and well enough to complete the class.

  • Checked how to use any equipment, it must only be used in line with the manufacturer’s guidelines.

  • Confirmed they are UK residents and are completing the class from the UK.

  • Have their camera working and on so that the teacher can see them throughout the class and they can see the teacher.

Acceptance of a new customer is at the discretion of Noue Yoga. Subject to being accepted as a client, when a person has signed the consent form, they will become a client subject to the Terms and Conditions.

Noue Yoga reserves the right to terminate with immediate effect, withdraw, suspend or refuse to access to a class, event or course for any Client whose conduct is, or may deemed to be in Noue Yoga’s reasonable opinion, damaging to the character of the business or acts or behaves in an aggressive or disrespectful manner towards any students or teachers of Noue Yoga. Any client who has been removed from a class, event or course will not be able to book on to any classes, courses or events in the future and will not be entitled to any refund for the class, course or event they were removed from or denied access to.

Noue yoga reserves the right to refuse admission to any class, event or course.

Timetable

Details of class, event and course dates and times may vary from time to time. Clients who have already booked on to a class, event or course which has changed time or date will be informed. Class, event and course times will be published by Noue Yoga on the website. Noue Yoga reserves the right to make changes to the schedule at its discretion. These changes to the schedule will be published on the timetable online.

Payment Terms

Details of the prices of classes, courses and events are available on the Noue Yoga website and are subject to change. Noue Yoga reserves the right to change the prices of classes, events or courses.

Payments for classes, events and courses are made non-refundable, non transferable and non-freezable.

Unless agreed by Noue Yoga, attendance of classes, events or courses are for use by the person named on the booking only and cannot be shared with, or again transferred to, another person.

Yoga Teachers

Katie New who teaches at Noue Yoga is fully qualified with a 200 Hour Teacher Training qualification. She also has the relevant personal liability insurance required.

Cancellation Policy

Customers can reschedule or cancel a yoga class, event or course up to 24 hours before the start time and date of the class or course. If you cancel within 24 hours of the class starting or do not show up to the class, you will be charged and receive no refund. Noue Yoga does not offer any refunds on any classes, courses or events already delivered. This does not affect your statutory rights.

If any of the classes, events or courses are cancelled by Noue Yoga in the 48hrs leading up to the class, course or event, you will be offered either a monetary refund or the option of being transferred to a class, course or event on an alternative date. Cancellation of classes, courses or events due to unforeseen circumstances may occur. Noue Yoga reserves the right to cancel classes, courses or events due to unforeseen circumstances that may occur. Noue Yoga reserves the right, at its discretion, to change or modify the schedule and to move times or locations of classes, events or courses.

Personal Information & Data Protection

Your personal information is secure and usage of your personal information is by Noue Yoga, which is part of these Terms & Conditions. Your information will only be used to provide you with the services you have purchased such as classes, events and courses. It is also used to maintain our records, process purchases and payments, to verify your identity, receive feedback and complete market research. Your information may be kept for a reasonable amount of time for the above reasons. Your information may be shared with third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. By agreeing to our terms & conditions, you consent to the use of your information including sensitive information relating to your health & fitness, for the reasons & manner explained above. Please get in touch with us if your personal details change, or if you have any queries about how your information is used. About using our site

You agree to use our site in accordance with these Terms & Conditions, only for lawful purposes and in a way which does not infringe the rights of anyone or restrict or inhibit anyone's use and enjoyment of the site. If you don't comply with these terms, we may deny you access to our site.

If you wish to make a booking, you should follow the instructions for making a booking that appear on the site. Any booking will be subject to your agreement to further terms and conditions related to that booking. We will notify you of the relevant terms and conditions, which you will have to accept to complete your booking. You may download content from our site only for your private, personal and non-commercial use. You agree to use the contact and booking forms on our site to make only genuine enquiries and/or bookings for you or for other persons for whom you are authorised to act.

You agree not to reproduce, distribute, modify or re-post our content on another site, frame or mirror our site or link to our site without our prior written consent. You agree to seek our written permission if you would like to link to our website or copy our content in any way, shape or form.

You grant to us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use (including but not limited to publishing, exploiting and modifying) any material you email, post or submit to us. By supplying us with material via digital or hard-copy, you allow us unlimited, royalty free use of its content. For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law. We try to update our site regularly, so we may have to suspend access, service or functionality from time to time, without notice. If required, we may have to close our site indefinitely. We will not be liable if, for any reason, our site is unavailable at any time or for any period of time. As information or data transmitted to or from our site passes over public telecommunications networks, we can’t promise that the operation of our site will be secure, confidential, uninterrupted or error-free. You agree not to do anything that does or may interfere with the proper working of the site including but not limited to tampering with, or hacking into, the site or the servers on which it resides.

Furthermore, by attending any of the Noue Yoga classes, events or courses, you agree to be photographed or filmed purely and solely for the promotion of Noue Yoga and any future classes, courses & events. If you are not happy to be photographed, please let us know before your class, event or course.

We may change this policy from time to time by updating this page.

Safety & Hygiene

All class participants are requested to wear a form of dress that is appropriate for the session they are attending.

Fitness & Health

Classes may involve intensive exercise. Each Client agrees to read and understand the type of class, course or event they sign up for prior to the class, course or event to assess if they are fit to participate in that class, course or event. Clients should refer to the website or speak to a member of staff for further information and seek guidance from a doctor or health professional.

Upon taking part in a class, event or course, each Client accepts these Terms & Conditions. Prior to each class, event or course, it is the responsibility of the Client to check that they are in good physical condition and that they know of no medical or other condition or reason why they are not capable of engaging in the class, course or event they are signed up for. They need to check that the exercises and practices in the class, event or course would not be detrimental to the health, safety or physical condition of the client. This is the responsibility of the client.

Noue Yoga teachers are not medically trained or able/qualified to assess if the Client is in good physical condition or can practice without risking detriment to the client’s health, safety or physical condition. If a client is unsure, they should consult a medical professional. Clients are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Noue Yoga reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be at risk by participating in a class, event or course.

Clients with the following conditions should not attend Classes, events or courses: blood pressure issues and cardiac irregularities. If there is any doubt, the Client should consult their doctor. Clients must notify the Noue Yoga of any circumstances affecting their health that may be exacerbated by a class, event or course.

Clients are required to follow the instructions of the teacher at all times during a Noue Yoga class, event or course.

Age Restrictions

If you are 18 and above you are able to attend any of our classes, events or courses subject to the other Terms & Conditions. Anyone under the age of 18 is unable to participate in classes, events or courses at Noue Yoga.

General Guidelines

Clients must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the teachers at Noue Yoga may issue to ensure the smooth operation of the classes, events or courses for the convenience of all Clients.

Clients are required to give written notice to Noue Yoga of any change of address, contact number or email address. Failing such notice, all communications shall be assumed to have been received by the Client within 5 days of Noue Yoga contacting them using the contact details they have. Noue Yoga may communicate with the Client by email. By providing an email address to Noue Yoga or filling in an email on an online form or through a booking process, the Client consents to receiving email communications from Noue Yoga, including notices pursuant to the Terms and Conditions. The Client also accepts any risk that email may not be a fully secure and confidential means of communication. Noue yoga will not be liable for any loss or damage suffered as a result of communicating with a Client in this manner.

When entering into an agreement with Noue Yoga by purchasing/attending classes or courses or completing forms, you automatically adhere to our T&C's. Anyone infringing on the aforementioned terms could be excluded.

Limitation of Liability

Noue Yoga cannot be held responsible for any service not being available for whatever reason. The Company reserves the right to make alterations to the types of classes, courses or events provided, without notice and in its absolute discretion and Noue Yoga shall not be liable for any loss occasioned by such alterations except insofar as loss is by law, incapable of exclusion.

It is the Client’s responsibility to ensure that they are capable of participating in the class, course or event they have chosen, and participating in a routine of exercises provided by the Noue Yoga teacher. Clients accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any course, event or class. Noue Yoga accepts no liability for loss or damage to property or injury of Clients except insofar as such loss, damage, or injury is by law incapable of exclusion.

Personal Belongings

Personal belongings brought to in-person classes, courses or events are brought into the venue at the client’s risk and Noue Yoga does not accept liability for any loss or damage whatsoever to such items.

Client’s are advised to place their valuables in a safe location in the venues of the courses, classes and events and not to leave them unattended.

During classes, courses or events that are in-person, phones should be silenced throughout the entirety of the class, course or event.
